Supreme Court of Belize upholds Department of Environment’s decision to grant environmental clearance for the Ara Macao Resort and Marina project.
In a written decision on May 7, 2007, the Supreme Court of Belize upheld the Department of the Environment’s decision to grant environmental clearance for the Ara Macao Resort & Marina project being developed by Ara Macao Development, Ltd. An organization known as Peninsula Citizens for Sustainable Development, as the Applicant, filed a claim challenging the Department’s grant of environmental clearance. The court found that the Applicant’s claim alleged facts that were incorrect and inaccurate stating further that all of the scientific points complained about were addressed in the exceedingly detailed environmental impact assessment complied by the developer. The court further ordered the Applicant to pay all costs associated with the complaint for both the Department of the Environment and Ara Macao Development, Ltd.
